Welcome to PHATBOT.
These Terms of Use (“Terms”) govern your access to and use of PHATBOT, including the PHATBOT mobile application, website, and related services.
PHATBOT is operated by Next Level Digital Media & Marketing (“PHATBOT,” “we,” “us,” or “our”).
By creating an account or using PHATBOT, you agree to these Terms. If you do not agree to these Terms, please do not use PHATBOT.
About PHATBOT
PHATBOT is a fitness and performance tracking application designed to help users record workouts, track training history, evaluate progressive overload, identify personal records and trends, and better understand their training performance.
PHATBOT may provide automated calculations, observations, reports, insights, suggestions, and other information based on information entered into the application or, when authorized, information from connected services such as Apple Health.
PHATBOT’s core product is designed around helping athletes understand their training progress, including workout history, progressive-overload calculations, personal records, scoring, reports, and progress information.
Fitness and Health Disclaimer
PHATBOT is provided for fitness, informational, and educational purposes.
PHATBOT is not a medical service and does not provide medical diagnosis, treatment, or professional medical advice.
Information, calculations, scores, recommendations, reports, trends, or other content provided by PHATBOT should not be treated as a substitute for advice from a physician, physical therapist, registered dietitian, or other qualified healthcare professional.
Exercise involves inherent risks, including the risk of injury.
You are responsible for determining whether you are physically capable of performing any workout, exercise, or activity.
Stop exercising and seek appropriate medical attention if you experience pain, dizziness, difficulty breathing, chest pain, loss of consciousness, or other symptoms that may require medical evaluation.
If you have a medical condition, injury, are pregnant, are beginning a new exercise program, or have concerns about whether an activity is appropriate for you, consult an appropriate healthcare professional.
Training and Performance Information
PHATBOT analyzes information available to the application to help users understand training performance.
Progressive-overload scores, personal records, strength trends, workout ratings, cardio comparisons, recovery observations, and similar information are estimates or analytical outputs based on available data.
PHATBOT does not guarantee that a particular workout, training approach, recommendation, score, or progression strategy will produce any particular fitness, strength, health, body-composition, or performance result.
Users remain responsible for their own training decisions.
Apple Health and Connected Data
PHATBOT may allow you to optionally connect Apple Health or other supported fitness services.
You control whether PHATBOT receives access to supported Apple Health information.
Apple Health access is not required to use PHATBOT’s core workout tracking features.
You may modify or revoke Apple Health permissions through Apple’s Health app or applicable iOS settings.
Use of information obtained through Apple Health is also governed by the PHATBOT Privacy Policy.
Your Account
You are responsible for maintaining the confidentiality of your PHATBOT account credentials and for activity occurring through your account.
You agree to provide accurate information when reasonably necessary to operate your account.
You may not attempt to access another person’s PHATBOT account or use PHATBOT in a manner intended to compromise the security or operation of the service.
Please notify us at hello@phatbotfit.com if you believe your account has been accessed without authorization.
Your Workout and Fitness Information
You retain ownership of the workout, fitness, notes, and other information you provide to PHATBOT.
You grant PHATBOT the limited rights necessary to store, process, analyze, display, and otherwise use that information to provide and improve the PHATBOT service.
PHATBOT’s workout history is designed to preserve completed training records and support historical performance analysis.
Our collection and handling of personal information is described in the PHATBOT Privacy Policy.
Acceptable Use
You agree not to misuse PHATBOT.
You may not:
- Attempt to gain unauthorized access to PHATBOT, another user’s account, or PHATBOT systems.
- Interfere with or disrupt the operation or security of PHATBOT.
- Introduce malicious software or harmful code.
- Use automated methods to excessively access, scrape, copy, or interfere with PHATBOT.
- Attempt to reverse engineer PHATBOT except where such restriction is prohibited by applicable law.
- Use PHATBOT for unlawful, fraudulent, abusive, or harmful purposes.
- Misrepresent your identity or impersonate another person.
Public Early Access
PHATBOT is currently being offered as Free Public Early Access.
No credit card is required. There is no trial countdown and no automatic paid conversion.
During Early Access, PHATBOT may change substantially. Features may be added, modified, removed, improved, or temporarily unavailable as we continue developing the product.
Early Access functionality may contain bugs, interruptions, inaccuracies, or other issues.
Your participation and feedback help us improve PHATBOT.
Future Paid Services
PHATBOT may offer optional paid features, subscriptions, or services in the future.
The availability of PHATBOT during Free Public Early Access does not guarantee that every current or future feature will remain free indefinitely.
If paid services are introduced, applicable pricing and terms will be disclosed before you purchase or subscribe to them.
PHATBOT will not automatically convert your current Free Public Early Access participation into a paid subscription without the appropriate purchase or authorization process.
Intellectual Property
PHATBOT, including its software, design, branding, graphics, scoring systems, reports, interfaces, and other proprietary materials, is owned by or licensed to Next Level Digital Media & Marketing and is protected by applicable intellectual-property laws.
These Terms do not transfer ownership of PHATBOT or its intellectual property to you.
You may use PHATBOT for its intended personal or authorized business purposes subject to these Terms.
Feedback
We welcome feedback, ideas, suggestions, and reports about PHATBOT.
If you voluntarily provide feedback, you agree that we may use that feedback to develop, improve, and operate PHATBOT without obligation to compensate you.
Availability and Changes
We work to keep PHATBOT reliable and available, but we cannot guarantee uninterrupted or error-free operation.
We may modify, suspend, restrict, or discontinue portions of PHATBOT when reasonably necessary for development, maintenance, security, legal compliance, or other operational reasons.
Account Suspension or Termination
We may suspend or terminate access to PHATBOT if we reasonably believe an account is being used fraudulently, unlawfully, abusively, in violation of these Terms, or in a manner that threatens PHATBOT, its users, or its systems.
You may stop using PHATBOT at any time.
PHATBOT also provides an in-app process for permanently deleting your account.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, PHATBOT is provided on an “as is” and “as available” basis.
We do not warrant that PHATBOT will always be available, uninterrupted, error-free, or completely accurate.
We do not guarantee particular fitness, health, weight-loss, strength, performance, or other results from using PHATBOT.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Next Level Digital Media & Marketing and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of PHATBOT.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.

Changes to These Terms
We may update these Terms as PHATBOT develops or as legal, operational, or product requirements change.
When material changes are made, we may update the effective date above and provide additional notice when appropriate.
Your continued use of PHATBOT after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
